Congress Leader Rahul Gandhi on Saturday said that it makes no difference to him whether he was disqualified from the Lok Sabha for some years, or permanently, and that he would not stop asking questions about the PM’s “relationship” with Adani. “Disqualify me, disqualify me for life. Put me inside jail. I will keep going. I will not stop,” he said. He had been disqualified because the “Prime Minister is scared of my next speech in Parliament… he is terrified. They don’t want that speech in Parliament,” he added.
Addressing a press conference at the AICC headquarters a day after he was disqualified as a member of the Lok Sabha following his conviction and sentencing for two years in a defamation case, Rahul Gandhi said that his ouster from Parliament was a “panic reaction” by Narendra Modi, who is “scared” and did not want him to make yet another speech on the “relationship” between the Prime Minister and industrialist Gautam Adani in the House.
Anurag Thakur hits back
Hitting out at Rahul Gandhi, Information and Broadcasting Minister Anurag Thakur said that the elected representatives automatically stand disqualified moment they are convicted by Hon. court to jail for two or more years. Government of India and Lok Sabha have no role to play. It can’t suspend or revoke disqualification. Rahul Gandhi is not the first to face disqualification. Wonder whether legal wizards of Congress have checked rules? Instead, they are brazenly defending their hatred for OBC which caused his conviction thus showing utter disrespect towards judiciary & people. Rahul Gandhi is a case of political immaturity, losing whatsoever little trust left, for gimmicks and cheap popularity.
He further said that in 2013 Lily Thomas Vs Union of India case, SC set aside Section 8(4) of RP Act which once protected convicted legislators from disqualification on account of their pending appeal. As per judgment, disqualification is automatically effective from the date of conviction. Constitution expressly prohibits Parliament to defer date from which a disqualification would come into effect. Lok Sabha Speaker is bound by the RP Act and Supreme Court judgment to issue membership termination order.
